现行三大诉讼法均未明确规定将测谎结论作为证据种类单列,诉讼法学界对此也存有争议。首先通过对否定测谎结论作为证据的观点进行反证分析后认为:测谎结论具有证据的客观真实性和关联性,可作为诉讼证据使用;再将测谎结论与司法精神病鉴定进行对比分析后认为,测谎结论可归于证据种类中鉴定意见一类。最后,建议对测谎技术作如下规范:一是制定行业标准,严格规范测谎员的资格认证;二是加强对测谎鉴定机构的监管。
None of the three existing Procedure Laws clearly make polygraph conclusion as the types of evidence which is listed separately;the academic circle of Procedure Law was also controversial about this.Firstly,Conducting a disproof analysis on the viewpoints making polygraph conclusion as evidence,we think that polygraph conclusions,possessing the properties of evidence which is real objective and associated,can be used as litigation evidence.Further by making a comparative analysis between judicial psychiatric appraisal and polygraph conclusion,it is thought that polygraph conclu-sion can be classified as the category of appraisal opinion.Finally,it is recommended to make the following specifications for polygraph technique:First,setting industry standards,strictly regulating the qualification certification for polygraph examiners;Secondly,strengthening the supervision of polygraph accreditation bodies.

专家辅助人制度是近年来我国诉讼法确立的一项新制度,无论在理论研究层面,还是在立法层面,乃至实践操作层面,专家辅助人资格的认定标准和认定程序都存在不足。在域外,存在与我国专家辅助人相似的一些制度,比如英美法系的专家证人制度、美国的法院之友、英国的技术陪审员、意大利的技术顾问、日本的诉讼辅佐人制度等,这些国家在规定这些制度时都对专家的资格审查、认定设立了相应的标准和程序。笔者在借鉴域外相关国家和地区法律规定的同时,结合中国现实国情,从专家辅助人的资格认定标准、资格审查程序以及其他辅助性制度等三方面提出建议。
Expert auxiliary system is newly established by procedure laws in China in recent years. Whether at the theoretical research level, or at the legislative level, and even at the level of practice, expert auxiliary personal qualiifcation identifying standards and procedures are quite inadequate. In the outside, there are some similar systems, such as expert witness system in Anglo-American law system, friends of the court in the United States, the British technical jury, Italy’s technology consultant, Japan''s lawsuit assistants, etc. These countries have established the corresponding standards and procedures of expert qualiifcation examination and identiifcation. In reference to the relevant laws and regulations from other countries and regions and combining with China’s real conditions, the author will give suggestions from three aspects: the specialist aided person''s qualiifcation standards, qualiifcation review procedures, and other auxiliary system.
