The term translation issue in “Public Law of Nations” is discussed from the as-pect of input,choosing and adjusting,cultural psychology and localization,namely,input,trans-fer,receiving.Translation motivation,strategy,and embodiment of Chinese traditional idea of law in the process of translation are explored.Chinese-Western legal terms as well as concepts are illustrated by comparing the source and target texts,to interpret Chinese tradition legal philoso-phies.It aims to provide reference for trans-discipline studies regarding to law,translation,and language and culture.

"的"字结构是中文立法语言的一大特点,是法律法规英译的一大难点。本文基于S姚arc姚evic提出的译者应发挥能动性使译文符合译入语的语言习惯的翻译观点,结合英汉语言形合、意合的差异,重点分析"的"字结构的特点与英译策略。语料为中国主要法律法规的英译本,取自"法律信息系统语料库"(CLIPS)。通过分析,发现法律法规中"的"字结构主要用于引导法律条件,表示法律假定因素、突出法律假定因素。在翻译该结构时,译者可通过添加连接词、补出隐含的中心语等策略使译文符合英语的行文习惯。
The“de”structure is frequently used in Chinese laws and regulations,which poses a big challenge for legal translators. This paper follows Sarcevic’s notion that legal translators should play an active role in adapting the translation to convention of the target language. Based on the differences between the Chinese and the English languages in terms of hypotaxis and parataxis,this paper first analyzes the features of the“de”structure and its translation strategies. The data of translated English versions of main laws in China are extracted from the Corpus for Legal Information Processing System(CLIPS). Through data analysis,it is found that the“de”structure is mainly used to introduce or emphasize legal conditions or circumstances. This paper then summarizes two strategies to translate the“de”structure:to add a conditional clause conjunction when the subject is present,and to choose and add an appropriate subject when the subject is omitted.
