法治文化是与人治文化相对应的一种人类文明进步的文化形态。一个法治国家乃至法治社会的形成,依赖于全体公民厚重的法治思想和牢靠的法治精神。法治文化是法治之魂,法治之脉,是法治中国建设重要的精神支柱和内在动力。进一步深化法治文化建设应注重挖掘、培育地方独具特色的法治精神;清醒认识法治文化建设的延续性和长期性,加强法治文化建设的全民参与性和生活化需求。

The culture of the rule of law is cultural morphology corresponding to a culture of human civilization progress. The rule of law and the formation of society are ruled by law, relying on thoughts of ruling by law for all citizens and sound spirit of the rule of law as the base. Culture is the spirit of the rule of law, vessels of the rule of law, which is an important spiritual support construction of rule of law in China and inner drive. Further deepen the cultural construction should focus on excavating, fostering unique legal spirit;recognizing the continuity and long-term culture of the rule of law, strengthening the rule of law and universal participatory culture and lifestyle needs.

自回归以来，围绕香港法治实践的激烈争鸣，可简约为“法治一元论”范式下的形式法治主义者与实质法治主义者之间的博弈。“法治一元论”难以准确地解读法治发展的基本规律，不利于凝聚港人的法治共识。依循“法治二元论”范式下的香港形式法治与实质法治二元发展路径，既可有效地调和相互冲突的法治观念，又能确保香港法治的良性发展，维护香港的长期繁荣与稳定。

Since the handover of the sovereignty,there has been heated discussions on HK practice of rule of law,which can as a matter of fact be briefly described as the gaming between the formalist and sub-stantialist theories of rule of law under the paradigm of the monist theory as far as rule of law is concerned, which does not correctly depict the basic mechanism of rule of law,casting negative effects on the reaching of the social consensus.Following the dualist paths of the formalistic and substantial rule of law can effec-tively reconcile the conflicting conceptions of rule of law,ensure the benign development of rule of law, and guarantee the long-term prosperity and stability in HKSAR.

提升领导干部的法治素养既是推进全面深化改革、建设社会主义法治国家、践行社会主义核心价值观的客观需要,也是各级领导干部健康成长的内在需求。一些领导干部的法治素养不容乐观,存在着法治信仰缺失、法治观念淡薄、法治能力不足等问题。提升领导干部的法治素养关键在加强法治教育、法治实践和制度机制建设。

To improve the leading cadres’qualities in rule of law is not only an objective requirement for deepe-ning the reform in an all - around way,building the socialist country under the rule of law,and practicing the so-cialist core value,but also an intrinsic demand for the healthy growth of leading cadres of all levels.
